NetHubble Technology Privacy Policy
NetHubble respects your privacy. We may acquire personally
identifiable information ("Personal Information") in conjunction with your
use of our Service or Site. This Privacy Policy ("Privacy Policy")
describes how we collect, use, and protect Personal Information.
This Privacy Policy is a part of and subject to the
Terms of Service ("TOS"). Accordingly, by using the Service or Site, you
agree that you have read, understand, and agree with the practices
described in this Privacy Policy.
COLLECTION AND USE OF
YOUR PERSONAL INFORMATION
Billing and Contact
When you sign up for a Service Plan or communicate
with us regarding the Web Site or the Service, we request information such
as your name, organization name, e-mail address, credit card number,
telephone number, and billing address. We use this information for our own
internal purposes, such as charging credit cards for Service Plan fees,
fulfilling requests for products or information, and providing customer
support.
We also use this information to send you information
on new products, promotional offers, and special events offered by NetHubble Technology. We may also
use this information to send you information on new products, promotional
offers, and special events offered by third parties. You can "opt out" of
receiving either or both of these types of notices in the My Account area
of the Site. However, NetHubble reserves the right to contact you
regarding your account, billing, and other issues associated with a
successful experience using NetHubble products.
Personal Preferences
When you set up your account, there are personal
preferences that you can set, including your name, organization name,
display name, custom message, personal web link, and presence; e.g.,
available or busy. This information is made available to all NetHubble
users who add you to their contact lists.
Contact Lists
When you set up your account, you can select the
third-party instant messaging accounts that you would like to associate
with NetHubble. The
contacts and groups from these third-party accounts will be automatically
imported into your NetHubble contact list. In addition, you may
choose to add other contacts who are not automatically imported from your
third-party instant messaging accounts, including other NetHubble -only users and email addresses of
people who are not using instant messaging. All of this information is
visible only to you and is maintained on our servers for the operation of
the Service.
Meeting Content
The meeting content that you share through the
Service may be accessed by other users, including people that you do not
know. Such content may include text chat, audio and video conferencing,
files, annotated shared screen data and annotated PowerPoint
presentations.
You may choose to use the built-in security features
of NetHubble to encrypt all
of this content. In this event, the live content stream should not be
accessible to anyone other than the participants during the meetings or
chat sessions. Of course, a participant may capture screens during a
meeting and share that content with other, unauthorized, people. We are
not responsible for the actions of our users. You should use care in
communicating with other users and only disclose your Personal Information
and other sensitive data to users who you know to be trustworthy. You
should not assume that your content will be kept private.
We do not regularly monitor any of your meetings or
chat sessions. We reserve the right to monitor use of the service to
ensure quality of the service and compliance with the law.
Usage Data
We collect information regarding your use of the
Service, such as the length and time of your meetings, the features used,
and the users with whom you communicate. We also collect information
regarding your use of the Site, such as domain and host names, Internet
protocol (IP) addresses, browser software and operating system types,
click stream patterns, and the dates and times that the Site is accessed.
We use this information to keep track of the minutes you have used in
connection with billing and to evaluate and improve the Service and Site.
We may also use this data to provide general statistics to potential
strategic partners, customers, and others.
DISCLOSURE OF
INFORMATION
If you are a member of a Group Plan, the
administrator of that Group Plan will have the right to view your usage
data and can share them with third parties.
We may disclose your Personal Information to
companies who work on behalf of NetHubble to provide the Service or Site.
Where possible, we will take reasonable steps to ensure that these
third-party service providers are obligated to protect your Personal
Information on our behalf.
We may disclose your Personal Information to respond
to subpoenas, court orders, or legal processes.
We may disclose your Personal Information if we find
that your actions violate the TOS.
We may disclose your Personal Information to any
successor-in-interest of ours, such as a company that acquires us and this
may result in your information being subject to a different privacy
policy.
SECURITY
Whenever we obtain your Personal Information, we will
use commercially reasonable efforts to protect it from unauthorized access
or disclosure. However, we cannot and will not act as insurers of the
security of your Personal Information transmitted over the Internet.
Accordingly, we assume no liability for any disclosure of data due to
errors in transmission, unauthorized third-party access or other acts of
third parties, or acts or omissions beyond our reasonable control.
AGE RESTRICTION
The Service is intended for users ages eighteen (18)
and older. Individuals under eighteen years old are not allowed to
purchase subscriptions to the Service or to download the client software
used in conjunction with the Service, whether it is a trial version or a
paid subscription. Accordingly, we will not knowingly collect or use any
Personal Information from individuals we know to be under the age of
eighteen. In addition, if notified in writing (or via e-mail), we will
delete any information in our database that originates from someone under
the age of eighteen.
SEVERABILITY
The invalidity or unenforceability of any part of
this Privacy Policy will not affect the validity or enforceability of any
other provision of this Privacy Policy, all of which shall remain in full
force and effect.
